Argyle Pool Services LLC: Pool Cleaning Service Disclaimer & Liability Waiver
This Pool Cleaning Service Disclaimer and Liability Waiver (“Agreement”) is entered into between the Client (“Customer”) and Argyle Pool Services LLC (“Company”). By scheduling, authorizing, or receiving services from Argyle Pool Services LLC, the Customer agrees to the following terms:
1. Scope of Services
Argyle Pool Services LLC provides routine pool cleaning and maintenance services, including skimming, brushing, vacuuming, chemical balancing, filter cleaning, and related tasks.
The Company does not guarantee the prevention of algae growth, staining, equipment failure, or water imbalance caused by factors outside its control such as weather, heavy usage, debris, or aging equipment.
The Customer understands that water chemistry can fluctuate between service visits.
2. Access to Property
The Customer agrees to provide safe, unobstructed access to the pool area on scheduled service days.
The Company is not responsible for missed or incomplete service due to locked gates, aggressive pets, or unsafe conditions.
3. Equipment & System Condition
Argyle Pool Services LLC is not liable for pre‑existing issues with pool equipment, plumbing, electrical systems, or structural components.
The Customer acknowledges that older, worn, or poorly maintained equipment may fail during normal operation or routine service.
4. Chemical Use & Water Conditions
The Company uses industry‑standard chemicals and dosing practices.
The Customer understands that:
Chemical adjustments may temporarily affect water clarity.
Weather, temperature, and bather load can impact water quality.
The Company is not responsible for discoloration or damage caused by minerals, metals, or pre‑existing water conditions.
5. Liability Waiver
To the fullest extent permitted by law, the Customer agrees to release, indemnify, and hold harmless Argyle Pool Services LLC, its owners, employees, and contractors from any claims, damages, losses, or expenses arising from:
Use of the pool during or after service
Slips, falls, or injuries in or around the pool area
Water chemistry changes between visits
Equipment malfunction not directly caused by the Company’s negligence
Property damage resulting from pre‑existing conditions or equipment failure
The Company is only responsible for damages caused by proven negligence.
6. Weather & Environmental Conditions
Severe weather, storms, or excessive debris may limit the Company’s ability to complete full service.
Argyle Pool Services LLC may reschedule service at its discretion for safety or operational reasons.
7. Cancellations & Rescheduling
The Customer agrees to provide reasonable notice for cancellations.
Missed visits due to lack of access may be billed at the full service rate.
8. Customer Responsibilities
Maintain proper water level.
Ensure pool equipment is operational.
Notify the Company promptly of any issues or concerns.
